Not happy with liposoft? what are my rights?

Hi everyone,
In Aug 07 I rang surgicare enquiring about liposuction for a pocket of fat just below my navel. I was basically "sold" liposoft. I went along with my mum for my initial consultation and I agreed to the procedure. When the surgeon examined me I was told that he would expect excellent results.

I had the surgery but it was with another surgeon. I was told it would take up to 6 months to see the results. April 2008 arrived and no difference. Also nobody contacted me about my follow up appointment!!! I rang and was told it was up to me to make another appt with them!!!. They said if I was not happy I had to see another surgeon and that new research suggested it can take 12 months for the final rseults to be seen.

I had to cancel that appt due to work commitments. I recontacted them and was scheduled another appt. This time I was told I had to take a letter of complaint with me. This was not told to me in April. Hours later I was then recontacted to say that there was no point seeing another surgeon and that I had to send them a letter of complaint. and after they had received this they would decide on the best course of action. This i did.

They have responded saying that they are not at fault. liposoft does not work on everybody and this was explained in the contract I signed. When I had my consultation thee surgeon was so positive for excellent results and it was not stressed to me that it might not work prior to signing the contract. They have offered me nothing. If they are not doing follow ups how can they gage their success rate?? I do not want my money back I want them to put right what they have not done.

They still have not seen the final results since the operation so how can they argue they have done everything right.

Can anyone advise what I should do?

can i just ask u which type of lipo u had? was it the normal type of lipo or did u have one of the new types e.g vaser or smart lipo?

Similar situation with unhappy results but for a different procedure.

Firstly you have to write to them (they have 20 days to reply)
Then you can write to the Healthcare commission
You can also write to the GMC about the way the procedure was sold to you
You can also take legal action - the patient consent is not a legal document and you are not bound by it. They have to explain things in full. It is hard to prove however your case sounds like it will be easy for you to resoolve (it does however take a long time)

You may have to wait for the full year to pass to see the results as this may be true and it may take time to see any difference (it sounds like you wont however you may have to go by the standard waiting time).

Have you thought about paying another consultant for a consultation to get their professional opinion?

Not happy with surgicare liposoft

I did write to them and basically they are not intending on doing anything so I intend to fight it all the way. I have paid for a service that I have not got. I have sought expert advice today and basically according to them they are in the wrong and have breached standard of care on two occassions.
It has been well over a year since I had it done and the results are poor to say the least.
Was your procedure with surgicare too? Iwas told today that they are notorious for it. Wish i had got the advice before going ahead with it!!
