Sorry to hear ur news

but i dont think they can do that if they offer u a transfer then it has to be with in so many miles or they have to give u time and money allowence to get to work and becaure ur preg im not sure they can even make u redundent any way u might be able to keep ur job if u can prove that there are others that should go b4 u if some one been there less time that u or have more time of sick that u i really think u should go to ur cit advice place and fine out if thins is all right coz i not sure it is good luck keep ur chip up but deff look into it xx

I was

transferred under TUPE and then made redundant whilest on maternity leave! Just won my unfair dismissal and sex discrim case two weeks ago!!

If you select TUPE transfer you will not be entitled to SMP as you wont have been working for the company long enough. (double check this.) So depending on the redundancy pay (what they offering you) I would go with redundancy rather than TUPE as you might get more out at the end of the day. (purely going on not being entitled to SMP)

IF you are entitled to SMP under TUPE - take the TUPE and then consider resignation when you become eligible for SMP as you can then still claim your SMP.

Hi vic

So sorry to her about your predicament. I've been made redundant so I know how much it sucks - its an emotional rollercoaster.

I've had a quick check on the net and I thought this fact sheet was good:

www.fawcettsociety.org.uk/documents/redundancyfeb09.doc.pdf

Basically, as long as they aren't selecting you for redundancy because you are pregnant they can do it. If you're far enough along you could start your mat leave now and then they can't make your redundant until after but I don't think you're far enough are you?

If you are in a union I'd give them a call - they'll take alot of the hassle out of it for you.

Hope this is helpful, please msg me if you need a hand, Sam x

I havnt but.....................

might be an idea to go to Citizens Advice, see how you stand on this, might be a case for un-fair dismisal??!! Worth a phone call xx

I hope it gets sorted xx

Adele xx
